Checkpoints Project Terms and Conditions

Please read these terms and conditions (“terms and conditions”, “terms”) carefully before using Checkpoints/Checkpoints Project (“website”, “application”, “service”), under the parent organization Checkpoints (https://www.checkpointsproject.com) operated by Technological Adventures LLC (“us”, “we”, “our”).

Conditions of Use

By using this platform, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly. Technological Adventures LLC only grants use and access of this website, its products, and its services to those who have accepted its terms.

By creating an account and using this platform, you agree to the following:

1) You, the user and primary account holder, will not share contents of the application with people not in the platform. All information shared on platform is the sole property of the original user sharing it and will remain private. This means no social media posts, screenshots, discussions with mainstream or independent media, blogging, and sharing in other media now known or will be devised in the future, as well as peer-to-peer sharing. This includes private sharing with your significant other, family, friends, or others if they are not also an account holder. Verbal confirmation that an individual is featured on the platform via a user’s story is allowed, but visual confirmation is prohibited. If a non-user wants confirmation about an individual’s presence on the app, they must sign up for the platform and/ or contact Technological Adventures LLC’s local office for express permission.
2) Sharing of identifiable information on the app pertaining to other users is strictly prohibited. All messaging within application is deleted within seven days- So If you need to write down contact information or save something important, do it sooner rather than later.
3) Do not post pictures with sexual material or sexually explicit photos. Do not post pictures depicting abuse. We believe your story and we do not require visual proof to post your story. We want to keep Creepstagram and Checkpoints Project as a whole a safe place and not post items like graphic photos that might trigger community members. Please use your best discretion when posting, and do not post photos or media that only one user has access to and can be traced back to a certain individual. This will prevent an abuser from discovering who specifically is on the platform, which in turn protects the original poster and all in the Checkpoints community.
3A) We will review all user reports of objectionable content within 24 hours and take immediate action, this can include but is not limited to, immediate removal of the content, immediate ejection of the user, and a lifetime ban from any and all current or further Technological Adventures products/projects, including Checkpoints.
4) You will not engage in any activity that could compromise the safety of the entire Checkpoints community. If you are found to be engaging in such activity, as determined by the moderators and owner of Checkpoints, you will be immediately removed and banned from the service and possibly subject to fines and/ or additional penalties, to be determined by Technological Adventures LLC.

Privacy Policy

Before you continue using our website, we advise you to read our privacy policy and user data collection policies regarding our user data collection. It will help you better understand our practices.

Age Restriction

You must be 13 (thirteen) or older to use this website. By using this website, you warrant that you are at least 13 years of age and that you or your legal guardian may legally adhere to this Agreement. Technological Adventures LLC assumes no responsibility for liabilities related to age misrepresentation.

Intellectual Property

You agree that all materials, products, and services provided on this website are the property of Technological Adventures LLC, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and intellectual property. You also agree that you will not reproduce or redistribute the Technological Adventures LLC’s intellectual property in any way, including electronic, digital, or new trademark registrations.

You grant Technological Adventures LLC a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company to come to an agreement.

User Accounts

As a user of this platform, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly. If you believe an account has been compromised, allowing an abuser or similar to have access to the platform, inform us immediately. We will issue you a new account at our local office and assign you the new account, while deleting your old one. Please keep your username safe and something you memorize- if an abuser gets access to your account, we can use that username to revoke all access. While we still have rampant block and report post features, revoking a user’s access remains the easiest/most reliable way of mitigating damage to other women.

We reserve all rights to terminate accounts, edit, or remove content at our sole discretion. Those found to be exploiting either the platform or its user will be terminated with no appeal. You may see a relative, a close friend or family member, someone you care about here, and you may want them removed- but them being related to you or connected to you doesn’t make them a good person. Plus, with the “feelings” framework- we aren’t ever making claims about someone, just how other women felt about interacting with them.

Any interactions in the Checkpoints platform are bound by this agreement, and Technological Adventures LLC assume no responsibility, financial or otherwise, for failed peer-to-peer sales or services.

Recording Policy

In the event a user triggers or responds to an SOS alert, their phone will be on and recording to potentially capture footage that can be used for evidence. Footage will recorded on the user’s phone as well as recorded remotely in Technological Adventures LLC’s servers.

We ask that the user please keep the locally recorded footage for at least 30 (thirty) days after the initial incident in case a backup recording is needed (in the case of corrupted or unusable footage on the remote side).

Those involved in the recording, whether the individual involved in the assault or the individual recording, can request that their image be removed and/ or blurred and their voices altered to protect their identify. The footage being shown is to establish a pattern of behavior from the alleged attacker, not to identify the alleged attacker’s targets. If a user turns in the footage but wants to remain anonymous- that request will be honored, and we will remove the user and only keep footage of the alleged assailant to establish a pattern of behavior in a court of law. No “Good-old-boy” legal defenses will stick when we have enough evidence to establish a pattern of behavior,

Applicable Law

By using this platform, you agree that the laws of North Carolina, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Technological Adventures LLC and you, or its business partners and associates.

Disputes

Any dispute related in any way to your use of this platform or to products you purchase from us shall be arbitrated by state or federal court in North Carolina and you consent to exclusive jurisdiction and venue of such courts.

Indemnification

You agree to indemnify Technological Adventures LLC and its affiliates and hold Technological Adventures LLC harmless against legal claims and demands that may arise from your use or misuse of our services. You also agree that while we have done our absolute hardest to protect you, posting information about your abuser can still result in legal action against you- While the framing, protection, and everything should be enough, abusers abuse the court system too. This platform was designed around feelings, not what actually happened, and keeping it that way should keep you as safe as we possibly can, but it IS still exposure. We reserve the right to select our own legal counsel.

Limitation on Liability

Technological Adventures LLC is not liable for any damages that may occur to you as a result of your misuse of our website or applications/ platforms. Technological Adventures LLC reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic communication. This Agreement is an understanding between Technological Adventures LLC and the user, and this supersedes and replaces all prior agreements regarding the use of this platform.
